Section 1

Preliminary Provisions

The online store SHOPWPC, available at the website shopwpc.com, is operated by the company LiderWood Daniel Miąskowski Sp.K. , registered in the National Court Registry with number KRS 0001086042, Tax Identification Number (NIP) 9581672650, National Business Registry Number (REGON) 363962812.

  • Consumer - a natural person who enters into an agreement with the Seller through the Store, the subject of which is not directly related to their business or professional activity.

  • Seller - LiderWood Daniel Miąskowski Sp.K. , registered in the National Court Registry with number KRS 0001086042, Tax Identification Number (NIP) 9581672650, National Business Registry Number (REGON) 363962812.

  • Customer - any entity making purchases through the Store.

  • Entrepreneur - a natural person, legal entity, or unincorporated organizational unit not being a legal person, which is granted legal capacity by a separate law, conducting business activity on its own behalf, using the Store.

  • Store's warehouse - the place for product collection in the case of personal pickup. Address: Grunwaldzka 35, 84-230 Rumia.

  • Distance contract - an agreement concluded with the Customer within an organized system of distance agreements (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication until the agreement is concluded.

  • Regulations - this Store's regulations.

  • Order - the Customer's declaration of intent made through the Order Form, aiming directly at the conclusion of the Product Sales Agreement with the Seller.

  • Order Form - an interactive form available in the Store that allows placing an Order, in particular, by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

  • Cart - a software element of the Store in which selected Products for purchase are visible, and the Customer has the opportunity to determine and modify the Order's details, in particular, the quantity of Products.

  • Product - a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.

  • Sales Agreement - a Product sales agreement concluded or to be concluded between the Customer and the Seller through the online Store.

Section 4

Technical Requirements

To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:

  • An end device with internet access and a web browser
  • An active email account
  • Enabled support for cookies
  • A contact telephone number

Section 5

General Information

  • The Seller is not liable for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unlawful actions of third parties, or the incompatibility of the online Store with the Customer's technical infrastructure, to the fullest extent permitted by law.
  • Browsing the Store's assortment does not require creating an account. Placing orders for Products from the Store's assortment is possible by providing necessary personal and delivery details.
  • Prices listed in the Store are provided in net and gross amounts (including VAT at a rate of 23%).
  • The final amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including fees for transportation, delivery, and postal services), which the Customer is informed about on the Store's pages when placing an Order, including at the time of expressing the will to conclude the Sales Agreement.
  • When the nature of the subject of the Agreement does not allow for prior calculation of the final price, information about how the price will be calculated, as well as about the delivery costs, will be provided in the Store.

Section 6

Order Placement Rules

To place an Order, you must:

  • Select products by clicking the "Add to Cart" button. If a product has variants, select the appropriate variant (size/color/length) from the dropdown on the product page, adjust the quantity according to your needs, and then click the "Add to Cart" button.
  • Fill out the order form by providing the recipient's Order details and address for Product delivery, select the type of delivery (Product delivery method), and provide invoice details if they differ from the recipient's Order details.
  • Confirm the Order by accepting the content of these regulations, and then click the "Buy and Pay" button.
  • Confirmation and order documents, including the invoice, will be sent electronically to the Customer's email address provided in the form.

If the "Delivery without unloading" delivery method is chosen (Section 7 point 1c), the Seller will contact the Customer to confirm the delivery conditions.

Section 7

Available Delivery and Payment Methods

The Customer can choose from the following methods of Product delivery or pickup:

  • Personal pickup - pickup possible at the Seller's warehouse (Grunwaldzka 29 or 35, 84-230 Rumia). Products can be packed at the Customer's request.
  • Courier parcel delivery - delivery by common courier companies such as DPD, InPost.
  • Delivery without unloading - delivery by a shipping company or the Seller's own transport. Unloading is the Customer's responsibility. To use this method, the Customer must provide access for a truck with a capacity of over 10 tons near the delivery location. In case of access limitations, the Customer is obligated to inform the Seller. In this case, delivery conditions will be individually agreed upon between the parties.

The Customer can choose from the following payment methods:

  • Payment by bank transfer to the Seller's account (account number provided in Section 3, Contact with the Store).
  • Electronic payments via Przelewy24.
  • Cash on delivery - in case of choosing the "Delivery without unloading" delivery method, the Seller reserves the right to collect an advance payment of up to 300 PLN to the bank account to fulfill the order. The advance payment will be determined electronically or by phone after placing an order in the online Store with the selected payment method.
  • Credit installment plan from Credit Agricole Bank.

Section 8

Execution of the Sales Agreement

The conclusion of a Sales Agreement between the Customer and the Seller occurs after the Customer submits an Order using the Order Form on the online Store's website, in accordance with Section 7 of the Regulations.

Upon placing the Order, the Seller immediately acknowledges its receipt and simultaneously accepts the Order for execution. Confirmation of the Order's receipt and its acceptance for execution occurs through the Seller sending the Customer an appropriate email to the email address provided during the Order placement, which contains at least the Seller's statements of receiving the Order and its acceptance for execution, as well as the confirmation of the Sales Agreement's conclusion. When the Customer receives the above email, the Sales Agreement is considered concluded between the Customer and the Seller.

If the Customer chooses payment by bank transfer, electronic payment, or credit card payment, the Customer must make the payment within 2 calendar days from the date of the Sales Agreement's conclusion, otherwise, the order will be canceled.

If the Customer has chosen a delivery method other than personal pickup, the Product will be dispatched by the Seller within the timeframe indicated in its description (subject to Section 5 of this paragraph), in the manner chosen by the Customer during the Order placement.

In the case of ordering Products with different delivery times, the delivery term is the longest specified term.

The commencement of the delivery term of the Product to the Customer is calculated as follows:

  • In the case of payment by bank transfer, electronic payment, or credit card payment – from the date the Seller's bank account is credited.
  • Product delivery is available within Poland.

Product delivery to the Customer is payable, unless the Sales Agreement states otherwise. The costs of Product delivery (including fees for transportation, delivery, and postal services) are indicated to the Customer on the online Store's pages during Order placement, including when the Customer expresses their will to conclude the Sales Agreement.

Section 9

Right to Withdraw from the Agreement

The Consumer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.

The 14-day period begins from the date of Product delivery to the Consumer or a person specified by them other than the carrier.

In the case of an Agreement that covers multiple Products being delivered separately, in batches, or in parts, the 14-day period begins from the date of the last item, batch, or part delivery.

The Consumer can withdraw from the Agreement by sending a declaration of withdrawal to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the declaration before the expiration of this period.

The declaration can be sent by traditional mail, electronically by sending it to the Seller's email address, or by filling out the form on the Seller's website. The Seller's contact details have been specified in Section 3.

The consequences of withdrawal from the Agreement:

  • In the event of withdrawal from a distance Agreement, the Agreement is considered null and void.
  • In the event of withdrawal from the Agreement, the Seller will promptly, no later than within 14 days from the date of receiving the Consumer's declaration of withdrawal from the Agreement, refund all payments made by the Consumer, including the cost of delivering the goods, except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller.
  • The Seller will make the refund using the same payment methods that the Consumer used in the original transaction unless the Consumer has expressly agreed to a different solution that does not involve any additional costs.
  • The Seller may withhold the refund until the Product is returned.
  • The Consumer should return the Products to the Seller's warehouse address specified in these Regulations without undue delay, but no later than 14 days from the day they informed the Seller about withdrawing from the Agreement. The deadline is considered met if the Consumer sends back the Product before the 14-day period expires.
  • The Consumer bears the direct cost of returning the Product, including the cost of returning the Product, if, due to its nature, the Product could not be returned by regular mail. The Consumer is also responsible for properly securing the goods for return. In the case of damage to the Product resulting from inadequate protection, the Seller may refuse to accept the return or may reduce the value of the return.
  • The Consumer is only responsible for the reduction in the value of the Product resulting from using it in a different way than necessary to establish the nature, characteristics, and functioning of the Product.
  • The right to withdraw from a distance Agreement is not available to the Consumer in the case of an Agreement where the subject of the performance is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy their individual needs, such as cutting boards according to an agreement between the Seller and the Consumer for the provision of services. In this case, the Seller has fully performed the service with the Consumer's explicit consent, who was informed before starting the service that, after the service is provided by the Seller, they will lose the right to withdraw from the Agreement.

    Section 10

    Complaints and Warranty

    New Products are covered by the Sales Agreement. The Seller is obliged to provide the Customer with a product free from defects. In case of a defect in the product purchased from the Seller, the Customer has the right to make a complaint based on the provisions of the civil code regarding warranty. The following elements are not considered defects if they do not significantly affect the use of the product: minor defects in the form of scratches, abrasions on the product's components resulting from storage, assembly, packaging, or transportation, minor color variations in the boards, especially when they are ordered separately at longer intervals. Complaints should be submitted in writing or electronically to the Seller's addresses provided in this Regulations. It is recommended to include in the complaint a concise description of the defect, the circumstances (including the date) of its occurrence, the Customer's data submitting the complaint, and the Customer's request regarding the defective product. Goods returned as part of the complaint procedure should be sent to the Warehouse address provided in § 3 of these Regulations. In the event of a valid complaint and the return of the product to the store, the delivery costs will be refunded in the maximum amount indicated on the Internet Store as during the order, which is equivalent to the market value of courier or forwarding services for the transportation of individual Products. The return of the product is the Customer's responsibility. The Store can assist in the return of the product after meeting the conditions allowing the acceptance and placement of an order for the collection of the product.

    Section 11

    Final Provisions

    Agreements made through the Online Store are concluded in the Polish language. The Seller reserves the right to make changes to the Regulations for valid reasons, such as changes in legal regulations, changes in payment and delivery methods, to the extent that these changes affect the implementation of the provisions of these Regulations. In matters not regulated in these Regulations, the generally applicable Polish law, in particular the Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act, and the Personal Data Protection Act, shall apply.
